In addition to the general terms of service and privacy policy, the following additional rules are incorporated into those terms and apply to your acting as an ambassador to promote our products and/or services:
Registration
Your application to become a KawaiiSale ambassador is subject to a manual review process in order to assess whether we’d make a good fit. The review process can take up to 2 business days and you will be notified via email with our final decision.
By becoming an ambassador you agree to receive occasional emails from KawaiiSale regarding changes in the FAM! program, news and updates or other information relevant to you as a KawaiiSale FAM! ambassador.
You must provide us with accurate information regarding who you are, your business details and the website(s) and/ or platforms you intend to promote KawaiiSale’s products.
Reasons for rejected applications include but are not limited to any websites and/ or businesses that:
- promote or display violence, discrimination, sexually explicit materials, copyright and trademark infringement, spamming, scamming, or any other illegal activities;
- replicate or resemble our website design (explicitly or implied) in a manner which leads customers to believe you are KawaiiSale or any other affiliated business;
- resell any of our products without authorization;
- are not aligned with our business standards or that are inappropriate for the product we sell.
Please note that this list is not exhaustive and that we reserve the right to decline your application at our sole discretion, without providing a rejection reason.
Payments & Commissions
- Standard commission rate is 10% of each purchase made by customers through your referral link or coupons. The commission is applied every time they make a purchase. VIB (Very Important Blob) members rate is 20%, available to those that have reached $5000 in referral sales.
- Standard cookie duration is 30 days. Therefore, the customers have a 30 day time frame from the moment they clicked on your referral link to decide whether to purchase our products or not. If they purchase after the cookie has expired, commissions will unfortunately not be registered (unless they use your unique affiliate coupon).
- Moreover, the commission will go to the last affiliate whose link was clicked (if the purchase is completed in the 30-day time frame).
- Affiliate payments are made approximately 15 days after the customer referred marked their purchase as complete (after they received their product). The money will be sent to the payment address they provided in the sign up process. Fraudulent signups associated with an affiliate, or suspicious activity may result in a longer payment period.
- Minimum payout is 50 USD. Payments will be made in USD into your Paypal account, between the 15th day of the month and the last day of the month. You can also request a payout at any time once approved and once you reach the minimum threshold.
- We reserve the right to lower or increase our standard commission rates at any moment and for any reason. You shall be notified via email before such changes go into force.
- All commissions are subject to approval in order to be subsequently paid. Each commission’s status will be available in your affiliate program dashboard as “Pending”, “Unpaid”, “Rejected” or “Paid”.
- You are allowed to use your own affiliate link to purchase from our store as long as it’s made in good faith and you are not reselling our products in any other marketplace or website.
- The cost of our products and services may change at any time and without notice. The affiliate payment for our products and services may change at any time and without notice. There is no guaranteed minimum payment from any referral.
- Any advertised payments to affiliates for referrals, whether a lump sum or a percentage, refer to the gross amount paid by us. What you receive may be slightly less after taking into account third party processing fees. In particular, payments to affiliates will primary be via PayPal with payments in US dollars, and PayPal or other merchant processing charges a fee for its services. - Payment amounts for a referral may differ between affiliates if separately negotiated in writing.
- Affiliates shall be responsible for all taxes and other similar levies as required by any law or regulation. Affiliate agrees as a condition of payment to accurately provide all identification and tax information necessary to allow us to comply with legal requirements.
- Affiliates understand that payment tracking can never be 100% accurate and this may be affected by events beyond our control, such as customers not accepting cookies or other mechanisms like ad-blockers/cookie blockers which prevent referral URLs to be tracked. If you believe your audience may be blocking your referral URLs encourage the use of your special coupon for the most accurate sales tracking. Relationships
- The ability to advertise our products and services as a brand ambassador is non-exclusive and revocable in our discretion for any reason.
- Ambassadors must always disclose your affiliate relationship with KawaiiSale.
- All proprietary information, trademarks, copyrights and all other similar rights in and arising out of our products and services are, and shall continue to be, our exclusive property. Ambassadors have a right to refer to our trademarks only so long as they remain active affiliates and otherwise comply with these terms.
- Ambassadors shall act exclusively as an independent contractor, and is not an employee or agent. Nothing in this Agreement shall create a partnership, joint venture, agency, or franchise between the parties. Ambassadors shall not sign any document in our name of or on behalf of KawaiiSale (Kawaii Ventures LLC), nor shall any ambassador hold itself out as being our agent or as having apparent authority to contract for or bind us to any contract.
- Ambassadors may not promote our products or services from any website or other location that engages in illegal conduct, according to both law of the jurisdiction where we are based and the law of the jurisdiction in which the affiliate resides. Additionally, affiliates agree to not promote our products or services from any website or other location that also contains or promotes ‘adult’ related products or services, whether or not there is nudity.
Advertising
Ambassadors are solely responsible for their own advertising, which must be truthful and not deceptive. Affiliate advertising is not pre-approved or reviewed by us but they must adhere to our brand and brand messaging.
The following promotional methods are permitted:
- Giving your referral link directly to your friends or potential customers that might be interested in our products;
- Writing a review on your blog or website about KawaiiSale and linking to our product with your affiliate link (or other provided creative asset);
- Writing an article on your blog or website on a subject from the affiliate marketing niche and linking to our product with your affiliate link (or other provided creative asset);
- Using your social media accounts to share your referral link with your audience (side note: make sure this is a practice permitted by the respective social network and that you comply with their Terms and Conditions as well);
- Promoting your referral link in emails, so long as the recipient is already a customer or subscriber of your services or website and they have the option to remove themselves from future mailings;
- Podcast mentions of your referral link and/ or discount code.
There are certain promotional methods we do not tolerate and will have your account terminated, shall you engage in such activities:
Junk Faxes
- It is against US federal law to engage in commercial advertising using unsolicited faxes to persons located in the US. It is against the law, even if your country or jurisdiction may permit unsolicited fax advertising until a person opt-outs from receiving further advertisements.
- We do not permit our ambassadors to send unsolicited faxes advertising any of our products or services to anyone, or promoting affiliate’s web pages or content on which our products or services are mentioned.
Spam
- It is against US federal law to engage in certain forms of commercial advertising using unsolicited email to persons located in the US.
- We do not permit our affiliates to send unsolicited email advertising any of our products or services, or promoting affiliate’s web pages or content on which our products or services are mentioned, irrespective of the law in your jurisdiction.
Other
- Affiliates are prohibited from copying, framing, or otherwise making our website appear on another domain.
- Misrepresenting our brand and product in any way (includes but is not limited to: misleading customers or using false information about our product, using fake testimonials, pretending you are an employee of KawaiiSale or that you are KawaiiSale, concealing or misrepresenting your identity or your affiliation to our business etc);
- Placing your affiliate link and/ or discount code on any coupon websites.
This is not an exhaustive list and we reserve the right to terminate your account whenever we consider your promotional activities are not aligned with our business values.
Account termination
Either you or we may end this Agreement at any time, with or without cause, by giving the other party written notice in the form of email.
Additionally, we reserve the right to terminate your account at any moment and without any previous notice, shall we consider that you breached any Terms and Conditions of this Agreement. Any pending or unpaid commissions that are subject to your violation of our Terms and Conditions will be withheld.
